OHUE Terms & Conditions

Please read these Terms & Conditions ("Terms") carefully before using the OHUE platform, provided by OHUE ("we," "us," or "our"). By accessing or using the OHUE platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, do not use the OHUE platform.

1. Acceptance of Terms

By creating an account, accessing, or using the OHUE platform, you signify your agreement to these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and OHUE.

2. Services Provided

OHUE provides a platform that enables individuals to:

• Integrate and view data from various wearable devices (e.g., Garmin, Whoop, Ultrahuman).
• Input and track blood marker data.
• Create and manage journal entries for personal health tracking.
• Grant authorized healthcare providers and trainers access to their aggregated health data and journal entries for personalized insights and guidance.
• Co-relate these diverse data points to provide a comprehensive and holistic view of an individual's health.

3. Not Medical Advice

THE OHUE PLATFORM AND ITS CONTENT ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ ON OR ACCESSED THROUGH THE OHUE PLATFORM.

4. User Accounts and Responsibilities

Account Creation:

You must be at least 18 years old to create an OHUE account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security:

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. OHUE cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Use of the Platform:

You agree to use the OHUE platform only for lawful purposes and in accordance with these Terms. You are solely responsible for all journal entries and any data you upload or link to your account.

Accuracy of Data:

While we strive to present your data accurately from connected sources, OHUE is not responsible for the accuracy or completeness of data provided by third-party wearables, lab results, or user/doctor/trainer journal entries. You are responsible for verifying the accuracy of all data.

Authorized Access:

You are solely responsible for granting and revoking access to your data for healthcare providers and trainers. OHUE is not responsible for any actions taken by third parties to whom you have granted access.

5. Data Privacy

Your privacy is paramount to us. Our Privacy Policy, incorporated by reference into these Terms, explains how we collect, use, store, and disclose your personal information. By using the OHUE platform, you agree to the terms of our Privacy Policy.

6. Integrations with Third-Party Wearables

OHUE integrates with various third-party wearable devices. Your use of these third-party devices and their associated services is governed by their respective terms and conditions and privacy policies. OHUE is not responsible for the operation, functionality, or data provided by these third-party devices or services.

7. Intellectual Property

The OHUE platform, including all text, graphics, logos, images, software, and other content, is the property of OHUE or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. Disclaimers

"AS IS" Basis:

THE OHUE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Guarantees:

OHUE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Reliance on Information:

YOU ACKNOWLEDGE AND AGREE THAT ANY RELIANCE ON ANY INFORMATION OBTAINED THROUGH THE OHUE PLATFORM IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OHUE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to defend, indemnify, and hold harmless OHUE, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the OHUE platform, including, but not limited to, your user content, any use of the platform's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the platform.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction, e.g., India, without regard to its conflict of law provisions.

12. Changes to Terms

By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms.

13. Termination

We may terminate or suspend your account and bar access to the OHUE platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the OHUE platform.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and OHUE regarding our platform and supersede and replace any prior agreements we might have had between us regarding the platform.
